Useful Information for U.S. Permanent Residents During the COVID-19 Pandemic

The U.S. Embassy and Consulates provide some helpful information for lawful permanent residents (LPRs) during the COVID-19 pandemic who are outside the United States and are unable to return to the United States at this time.

*** Some important information to note:

- The U.S. Embassy and Consulates do not have any authority over travel policies for lawful permanent residents (LPRs).

- The U.S. Citizenship and Immigration Services (USCIS) has sole jurisdiction over the status of permanent residents and any requests for official guidance regarding permanent residents should be directed to USCIS.

- The USCIS does not have an office in Vietnam.

*** Some frequently asked questions and answers:

1/ As a permanent resident, how long can you stay outside the United States without risking losing your permanent resident status?

Generally, permanent residents can stay outside the United States for up to 1 year. If you have been issued a Re-Entry Permit, which must be applied for while you are in the United States, you may remain outside the United States as long as your Re-Entry Permit is valid. Please note that under USCIS regulations, in some cases a permanent resident may be considered to have abandoned permanent residence for trips of less than one year if USCIS concludes that you did not intend to make the United States your permanent residence.

2/ Now that you are outside the United States and cannot return to the United States, can you apply for a Re-Entry Permit?

According to USCIS policy, you cannot apply for a Re-Entry Permit while you are outside the United States. You must apply before you leave the United States. Additionally, a Re-Entry Permit cannot be renewed once it has expired.

3/ Will USCIS consider the current COVID-19 situation to be a special circumstance and allow affected permanent residents who are currently outside the United States to maintain their LPR status?

There have been no announcements or policy exceptions issued by USCIS on this issue. Permanent residents who have been outside the United States for more than 1 year, or beyond the expiration date of their Re-Entry Permit, will essentially be considered to have abandoned their LPR status.

If you want to return to the United States, you must apply for a SB-1 reentry visa at the Immigrant Visa Unit.

4/ What if your green card is lost or expired?

You can apply for a Boarding Foil at the U.S. Embassy (Hanoi) or the U.S. Consulate (Ho Chi Minh City).

5/ What if there are no more flights from Vietnam to the United States?

There are still flights from Vietnam to the United States. The U.S. Mission in Vietnam has compiled a list for U.S. citizens who wish to return home. Permanent residents may also consult this list, but we encourage you to contact the airlines directly to confirm flight frequency and schedules. The U.S. Mission in Vietnam is not responsible for any changes to flight schedules or other related changes.

6/ What if a permanent resident is elderly or has an underlying medical condition and is unable to return to the United States due to the current COVID-19 situation in the United States, but still wishes to maintain LPR status?

Please direct questions of this type to the U.S. Citizenship and Immigration Services (USCIS). USCIS has sole jurisdiction over permanent residents and any requests for official guidance regarding permanent residents should be directed to USCIS. The U.S. Mission in Vietnam cannot answer these questions and does not have the authority to make any formal determinations regarding LPR status. You should contact USCIS directly or consult the resources available on the USCIS website. Our office does not have the authority to advise or provide guidance on how an LPR should proceed.

7/ What if you have contacted USCIS but have not received a response?
